1. Acceptance of Terms

By accessing or using Pulsemark ("the Platform", "we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree, do not use the Platform.

2. Description of Service

Pulsemark is a social media management platform that allows users to create, schedule, publish, and analyze content across multiple social media channels including but not limited to Facebook, Instagram, LinkedIn, TikTok, and X/Twitter.

3. Account Registration

3.1 You must provide accurate and complete information when creating an account.

3.2 You are responsible for maintaining the confidentiality of your login credentials.

3.3 You must be at least 18 years old to use this Platform.

3.4 You are responsible for all activity that occurs under your account.

4. Subscriptions and Billing

4.1 Paid plans are billed in advance on a monthly or annual basis as selected.

4.2 You may upgrade, downgrade, or cancel your plan at any time.

4.3 Refunds are handled in accordance with our refund policy as displayed during purchase.

4.4 We reserve the right to change pricing with 30 days notice.

4.5 Failure to pay may result in suspension or termination of your account.

5. Acceptable Use

You agree NOT to:

5.1 Use the Platform for any illegal purpose or in violation of any applicable law.

5.2 Post content that is abusive, threatening, defamatory, or harassing.

5.3 Attempt to gain unauthorized access to any part of the Platform.

5.4 Use the Platform to send spam or unsolicited messages.

5.5 Interfere with or disrupt the integrity or performance of the Platform.

5.6 Violate the terms of service of any third-party social media platform.

6. Third-Party Services

The Platform integrates with third-party social media platforms. Your use of those platforms is subject to their respective terms of service and privacy policies. We are not responsible for the actions or policies of these third-party services.

7. Intellectual Property

7.1 The Platform, its code, design, and branding are owned by Pulsemark and are protected by copyright and other intellectual property laws.

7.2 You retain ownership of the content you create and publish through the Platform.

7.3 You grant us a license to access and process your content solely for the purpose of providing the Service.

8. Limitation of Liability

8.1 The Platform is provided "as is" without warranties of any kind, express or implied.

8.2 We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform.

8.3 Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

8.4 We are not responsible for any downtime, data loss, or service interruptions caused by third-party social media platforms.

9. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms. Upon termination, your access to the Platform will cease, but your data may be retained as required by law.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Platform. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms shall be governed by the laws of the Republic of Uganda. Any disputes shall be resolved in the courts of Kampala, Uganda.
